Welcome to Friend in the Cloud (“FITC”, “we”, “us”, or “our”). By accessing or using our platform, you agree to be bound by these Terms and Conditions. Please read them carefully.

1. Acceptance of Terms

By creating an account or using Friend in the Cloud, you confirm that you are at least 18 years of age and agree to these Terms. If you do not agree, please do not use the platform.

2. Description of Service

Friend in the Cloud provides AI-powered companion chat services. Our platform is designed to offer emotional support, conversation and personal growth assistance. It is not a medical, psychological or therapeutic service.

3. Your Account

• You are responsible for maintaining the confidentiality of your account credentials.
• You agree to provide accurate information when creating your account.
• You must notify us immediately of any unauthorised use of your account.
• One account per person. Creating multiple accounts to circumvent limits is prohibited.

4. Subscription Plans and Payments

• Free plan: 40 interactions per day at no cost.
• Pro plan: $6.99/week or $19.99/month, billed via Stripe.
• Unlimited + Marketplace plan: $14.99/week or $49.99/month.
• Marketplace companion subscriptions: $7.99/month per companion.
• All payments are processed securely by Stripe. We do not store payment card details.
• Subscriptions renew automatically until cancelled.
• Refunds are considered on a case-by-case basis. Contact [email protected].

5. Marketplace

• Only Unlimited plan members may list companions for sale.
• Companions must have a minimum of 1,000 quality interactions and a star rating of 3 or above.
• Sellers receive 70% of subscription revenue. FITC retains 30%.
• Payouts are made via PayPal when balance reaches $100.
• FITC reserves the right to remove listings that violate our community standards.

6. Acceptable Use

You agree not to use Friend in the Cloud to:

• Harass, abuse or harm others.
• Generate illegal, hateful, or explicit content.
• Attempt to reverse-engineer, scrape or exploit the platform.
• Misrepresent yourself or impersonate others.
• Use the service for any commercial purpose without our written consent.

7. AI-Generated Content

Responses generated by our AI companions are for informational and emotional support purposes only. They do not constitute professional advice. Always consult qualified professionals for medical, legal, financial or psychological matters.

8. Intellectual Property

All content, branding, and technology on Friend in the Cloud is owned by us or our licensors. You may not reproduce or distribute our content without written permission.

9. Termination

We reserve the right to suspend or terminate accounts that violate these Terms, without notice. You may cancel your account at any time via your account settings.

10. Limitation of Liability

Friend in the Cloud is provided “as is”. To the maximum extent permitted by law, we are not liable for any indirect, incidental or consequential damages arising from your use of the platform.

11. Changes to Terms

We may update these Terms from time to time. Continued use of the platform after changes constitutes acceptance of the updated Terms.
